What happens to all my digital stuff when I die?






I know it's a bit morbid but I've been thinking about death recently and what happens to all my stuff after I've gone. Not my watch, or my house, or my fine collection of purloined restaurant ashtrays from a bygone smoking era - that's a lot easier. It's the digital stuff that has got me bothered. 

What happens to my Facebook account? What happens to my music and movies on iTunes and Spotify? What happens to my blog on Google? And the list goes on and on...

Well the truth is that legislators have failed to keep up with the growth in ownership of digital property and who actually owns it after you move on to that digital afterlife in the sky. Many people think that Facebook will simply archive your data but that's not what they say in their terms of service. Nor will Facebook turn over login names or passwords unless forced to by a court order. 

And in fact that pretty much goes for most online companies. You can be a family grieving the loss of a loved one but most corporate policies are written with protecting privacy in mind. So for example, Yahoo accounts are non-transferable and rights to all content within them terminate on your death, leaving families locked out of email archives and wedding albums, even if the deceased wanted to share them. 

Some States in the US are moving with the times – no sign of action in the UK – in Oklahoma and Idaho for example, digital data are treated like tangible property and the executor of a will can take control of social networking or email accounts just like a bank account.But in the most part this not the case, so you should start thinking of talking to your lawyer about including your 'digital wishes', so at least your intentions are known along with passwords and usernames. 

In fact if you're like me, most of them are in your head and if I get hit by that number nine bus this afternoon and pop my clogs, it's going to cause a whole lot of hassle for a load of people.

Thinking about it, where's the number to my lawyer......
